Exceed PCA Charges – Wholly Suspended Sentence
Our client was facing a total of 3 charges for various traffic offences. Specifically, the charges were:
- Exceed PCA 49(1)(b)
- Exceed PCA 49(1)(f)
- Driving Disqualified
Our client had already been in court five times in the past due to related offences. He is a man in his mid 40’s with consistent employment.

Our client ultimately received a wholly suspended sentence and a fine. The magistrate imposed a prison term of 3 months to be wholly suspended for 12 months, and a fine of $1,000. This was a good result especially that even a fifth drink driving offence could likely end up in an immediate term of imprisonment.
