Exceed PCA Charges – Good Behaviour Bond

Our client was facing several traffic offences which include both drink driving and non-drink driving. The drink driving offences arose from a blood alcohol concentration reading of 0.1%.

Shaun Pascoe acted on our client’s behalf at the Heidelberg Magistrates’ Court on the following charges:

  • Exceed PCA 49(1)(b)
  • Exceed PCA 49(1)(f)
  • Fail to keep left of the dividing lane
  • Fail to stop when Police signal
  • Dangerous driving

Our client has never been previously charged with any driving or criminal offence.

Amendments to the Prosecution Summary were made in regards to some aggravating facts that were not consistent with what really occurred according to our client. We made submissions to the court emphasising on our client’s willingness to take responsibility for his actions. We highlighted the fact that our client had never reoffended during his suspension period.

The Magistrate ultimately sentenced our client to a good behaviour bond.
